Our Legal Basis for Using Your Personal Information – Where it matters under applicable regulations, every use of your personal data must have a valid legal reason (“lawful ground”). These possible grounds are described below.

Information We Collect

Information You Provide. By joining the Site, using it, completing forms, taking part in skill quizzes or surveys, or enrolling in newsletters or events, or if you act as a collaborator, or sign up for our affiliate, influencer, or comparable programs, you may give us or otherwise provide personal data including a functioning email address, login credentials, name and user name, profile info (like your image, education, professional skill set), physical/billing address, phone or other contact data, birthdate, transactional or payment info (like chosen payment method, credit card data), tax details and forms (like W-9 and DAC-7), data on social network accounts linked, content about your posted orders, your transactions, or reviews/ratings, and any user-generated materials or files you put on the Site (including audio or other sensory data for audio-based services). In certain circumstances, we can also request ID verification (scans of government-issued ID, passport, or driver’s license, or social security number) and potentially biometric data gleaned from photos and ID docs you upload as further explained in “Verifying Your Identity” in our Help Center. Business sellers on Digilancer must submit more data to validate their business (details under “Account Verification”). We also gather and store info from your messages with Digilancer, your forum/blog posts, and your interactions with other Digilancer users.

Information We Collect Automatically. While you peruse, click, scroll, engage with, or in any way utilize the Site, we gather information on your actions with other users, including transactions or communications, the searches you conduct, which pages you scroll or look at, plus your clicks and any navigational behavior. We additionally retrieve usage-related data like your IP address, approximate geolocation, device and OS details, language or currency settings, session length, keyboard setup, type of browser, browsing logs, and the URLs you visited before and after you used our Site. Also, we gather data about the usage of cookies and the like, as described further below.

To upgrade your user experience on Digilancer, we track impressions when you see our advertisements; we capture a Global Unique Identifier, plus HTTP request data, including user agent, IP, host, URL, country or continent, plus your device, OS, and browser.

Information We Receive from Third Parties. We may receive information from third-party sources for commercial or public usage:

Certain third parties who provide supplementary information (adhering to relevant laws) that we can add to your record. For instance, we may gather alerts on fraud and security from outside providers, as part of our security or fraud-prevention measures. We might also get data such as your role or place of work from data-enrichment partners so we can fine-tune the user experience and potentially recommend relevant services. Marketing and advertising partners can supply info to help us administer campaigns and measure effectiveness.

If you integrate or log in via a social platform (like Google, LinkedIn, or Facebook), we obtain applicable details (email address, name, photo, etc.) from that service, though the specifics vary and are determined either by the platform’s controls or by you through your chosen privacy settings there.

In the event a user or other third party files a report or complaint about you or your actions on Digilancer, we may collect details about that complaint and investigate as needed.

If you authorize us to import your Google Workspace contacts, we will have limited access, consistent with your permission, so you can invite them to your Digilancer account. We reserve the right to use anonymized aggregated contact data for internal business objectives.

Should you incorporate third-party data into your account or combine your profile with third-party tools, systems, or solutions, we will gather details about you according to your permissions for that third-party platform.

We also receive certain data about you if another user brings you onto Digilancer (say, using collaboration tools or a referral code). We will gather just what’s necessary, like your email or some other contact method, and will use it for the same original purpose plus everything described in this Policy.

We merge your personal information with other data that we collect automatically or obtain from outside sources, applying it as indicated in this Policy.

Our Legal Basis for Using Your Personal Information

 Under applicable statutes, the handling of your personal information is permissible only if grounded in a valid “lawful basis.” Most commonly, we rely on the following:

Your voluntary consent for a specific use of your data;

The necessity of using the data to finalize a contract or take steps to do so with you (for example, to deliver purchased services);

How Do We Use The Information Collected?

Direct marketing:

 We utilize your personal data to send you direct promotional content about our offerings, products, or discounts that might interest you, or about Digilancer’s extended services. This may involve mail, email, phone, SMS, or even targeted ads online.

Our reliance on your data for direct marketing may be grounded in our legitimate business interests, your explicit permission, or another basis allowable by law. You retain the privilege to stop any direct marketing at any time by following the unsubscribe link in each communication or by emailing optout@digilancer.com. We try to limit how often we contact you and ensure what we send is potentially helpful, based on the information we hold about you.

Additionally, the Site uses reCAPTCHA for security, which adheres to Google’s Privacy Policy and Terms of Service. Google reCAPTCHA is necessary for preventing fraudulent, automated machine misuse. More details are found in Google’s policies.

How Long Do We Keep Personal Information?

 We typically store personal data for only as long as necessary for the reason we initially collected it. Nonetheless, we may occasionally keep it longer for reasons that include:

Routine operational needs (like preserving a record of interactions in case of complaints or challenges).

Compliance with laws if data must remain for a set timeframe, for example to deter fraud, recover owed payments, resolve disputes, identify issues, or implement our Site rules (or any other actions we’re allowed by law).

Observing statutory or similar requirements that bind Digilancer.

Preserving evidence within the relevant limitation timeframe.

Children

 The Site is explicitly presented to individuals who are at least 18 years old and thus are able to form a binding agreement. If someone is at least 13 but under 18, they must only use the Site through an account supervised by a parent or legal guardian, with express consent. Persons under 13 are not permitted to use the Site or related Digilancer services. We intentionally avoid collecting children’s personal data under 13. Parents or guardians should watch over their children’s online usage. If we discover that we gathered personal information of a child under 13, we will promptly discard it. Sharing Personal Information with Third Parties

 We share personal data with specific outside entities in accordance with the details below:

With other users and Site visitors. After you sign up, your username, country, and selected profile information is publicly shown to all Site visitors. This might cover images you upload, your displayed samples, your Orders, ratings/reviews, or any data you elect to make visible. When you file a report or complaint. If you lodge a complaint regarding another user, we may give that other user enough data to address or dispute the matter, or as required by law.

For legal reasons. We share personal data with public authorities or legal entities if subpoenaed or court-ordered, or if we think disclosure is lawful or vital for adhering to legal obligations. This may include investigating alleged wrongdoing, preventing breaches of law, security, or policy, shielding Digilancer’s property, or ensuring user and public safety.

For payments and fraud detection. We share data with payment platforms, fraud monitoring services, and third parties to handle transactions placed through the Site and safeguard it from fraudulent activities, money laundering, or other liabilities.

With social media partners. The Site offers social media functions and single sign-on. We also share personal data with platforms such as Facebook or Google, specifically for marketing or the Digilancer marketplace’s promotion. These services collect certain info about you, sometimes via cookies. They abide by their own policies regarding how they store and employ that data.

With corporate affiliates. We exchange personal data with Digilancer’s affiliated companies to operate our or their businesses, offer complementary services, prevent fraud, keep our environment secure, highlight our or our affiliates’ services, and for all additional reasons stated in this Policy.

During business restructuring. Personal data could be exposed if Digilancer faces a merger, acquisition, or sale (full or partial) of corporate assets, or in insolvency or a similar occurrence. If any or all of Digilancer’s business/assets are acquired by another entity, user data can be among the transferred assets.

Where We Process Your Personal Information

 Some personal information you send us may be kept or handled by outside providers or processors in jurisdictions such as the United States or Israel, whose data privacy statutes may differ from yours. Transferring data either internally or to external parties might lead to personal information being moved from the European Economic Area (“EEA”) to nations outside it that may not present the same level of data security (like the United States). Always check each site’s privacy policy. This Policy strictly regulates data collected on our Site. If you post or tag the Site on a social platform, your submission is subject to that network’s terms, even if it’s shared via an official Digilancer page. We have no control or review over those external terms or policies. Inspect them thoroughly before sharing personal data.

Security

 We adopt organizational and technological security measures to protect the Site, our services, and personal data against unauthorized use, loss, misuse, tampering, or damage, using recognized tools and procedures. For instance, where relevant, we maintain PCI DSS (Payment Card Industry Data Security Standards) compliance for credit card handling. We obligate any outside entity that processes personal data on our behalf to ensure confidentiality and security. However, the internet isn’t 100% secure, and while we strive to shield your data, we can’t promise absolute security. Once we have received your data, we employ rigorous protocols and controls to deter unauthorized infiltration.

Registered Site users must keep their password and other login data private and not share it with any third parties.

Specific Provisions for EU, EEA and UK Users

 This segment of the Policy applies if you reside in the EU, European Economic Area (EEA), or UK.

For GDPR purposes, Digilancer International Ltd. (8 Kaplan St., Tel Aviv, Israel) is the “Controller” for processing personal data as outlined in this Privacy Policy.

You are entitled to the following rights under the EU and UK General Data Protection Regulation (“GDPR”):

To know how and on what legal grounds we handle your data, and to request a copy of it;

To have inaccurate personal data fixed;

To demand the deletion of your data, under specific conditions, including if we no longer need it for the original purpose or if our lawful basis was consent and you withdraw consent with no alternate basis;

To block or restrict certain usage of your personal data if the accuracy is contested, the processing is illegal, we don’t need it anymore, or if you object based on legitimate interest and we are analyzing it;

To object to automated decision-making or profiling purely driven by algorithms;

If you provided data with your approval, to request we provide that data in a machine-readable file or forward it to another data controller (data portability);

To request info about or a copy of safeguards we apply for transferring data outside the EEA.

Information tracked automatically when you use Digilancer, covering (i) identifying data (IP address, device specs, and browser details); (ii) commercial info (what you consider buying, your purchase history); (iii) usage data (login times, session length, and pages visited); and (iv) approximate location data.

Information gathered or obtained from third parties like service providers, promotional partners, or linked accounts, containing (i) identifying data and contact info, (ii) job or professional details, (iii) usage data like pages viewed, (iv) commercial info, (v) location data.

Inferences that can be drawn from any of the above data to create a user profile.

We utilize the above data for purposes outlined in “How Do We Use the Information Collected?”

We might disclose these data categories for a business purpose as summarized in “Sharing Personal Information with Third Parties.” Over the previous 12 months, we disclosed all categories listed above for a valid business reason.

Although we do not monetize or trade your personal information, we may share personal data with marketing affiliates to deliver tailored content or ads based on your preferences on external websites—under certain state privacy laws, this might qualify as “selling” or “sharing” personal information. Deleting or Updating Personal Information

If you eliminate User Generated Content (“UGC”) as described in the Digilancer Terms of Service, it may still exist in cached or archived forms, or remain copied by other Site participants. The correct usage of data posted on the Site, including UGC, aligns with our Terms of Service.
